September,15,2015: The ruling AAP on Tuesday asked Somnath Bharti to surrender before police even as the former Delhi Law Minister approached the Delhi High Court seeking protection from arrest in a case related to domestic violence and attempt to murder filed by his wife.
Sources said the party was upset with Mr. Bharti as it is unable to contact him.
“We are trying to contact him, but are not able to. We advise him to surrender before police,” said AAP leader Ashutosh.
Party sources, meanwhile, said that Mr. Bharti’s “remaining incommunicado” was sending a wrong signal as AAP has been maintaining the stand that the Delhi Police have been victimising its MLAs by arresting them.
Three AAP MLAs — another former Law Minister Jitendra Singh Tomar, Manoj Kumar and Surinder Singh — have faced arrest by the Delhi Police. If taken into custody, Mr. Bharti will be the fourth AAP MLA to be arrested in the last four months.
The Malviya Nagar legislator on Tuesday approached the Delhi High Court after a local court on Monday rejected his anticipatory bail plea and issued a non-bailable warrant against him.
Meanwhile former Delhi Law Minister approached the Delhi High Court on Tuesday for anticipatory bail.
Mr. Bharti’s counsel mentioned the matter before a division bench of Justice B.D. Ahmed and Justice Jayant Nath and sought urgent hearing of the plea. The court posted the matter post-lunch before an appropriate bench.
On Monday, a trial court issued non-bailable warrant against Mr. Bharti in a domestic violence case after police informed it that he was not cooperating in the probe. The trial court also dismissed the AAP legislator’s anticipatory bail plea.
Police told the court that Mr. Bharti, a legislator from Malviya Nagar constituency, was an “influential” person, due to which nobody was coming forward to depose against him.
