Central Govt: Now Women fighting sexual harassment at work place will get 90 days’ leave

Women employees of central govt. who file complaints of sexual harassment at workplace now have the option of getting ninety days paid leave during pendency of inquiry under the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013.

This move is significant as there have been complaints of those people accused of sexual harassment trying to threaten or influence the victims.

Special leave in this case’ll be given on recommendation of the internal committee or local committee formed to look into such charges.

The leave granted to aggrieved woman employee shall not be debited against leave account, the dept. of personnel & training (DoPT) said.

The DoPT has also issued Central Civil Services (Leave) Amendment Rules, 2017 to allow this new provision.

In December, DoPT had issued guidelines to deal with sexual harassment of women at workplace. The guidelines stipulated that inquiry of the cases must be completed within 30 days only & under no circumstances should it take more than ninety days from the date of complaint.

Departments & ministries have to keep a watch on the complainant so as to ensure that she’s not victimized in any manner because of having filed a complaint. All ministries have to submit reports every month to the ministry of Women & Child development so that the progress can be monitored.
As per the guidelines, aggrieved woman had the option of sending a representation to the head or secretary of the organisation in case she felt she’s being victimized because of her complaint. The concerned authority would be required to dispose of the complaint within 15 days.
