Govt. of India has proposed an Amendment to the Rules applicable to sexual harassment cases in order to strengthen the participation of Complainant.
It is proposed that he committee inquiring sexual harassment complainant share its findings with the complainant of the matter in cases where no action for punishment is recommended or contemplated by the Committee against the alleged accused.
The inquiry panel will have to, post amendment, provide not only a copy of its report to the complainant but would be required to consider any representation or protest filed against its findings, as done in an appeal before completing its report.
The Department of Personnel has issued a Circular directing all Govt. Ministries and their Departments to notify the proposed change to concerned stakeholders and obtain their views by 21st June.
Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal), Rules,2013 were notified by GOI post the promulgation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act,2013.
