CJI T S Thakur’s era on its end as SC Collegium awaits new Chief Justice for important pending decisions

Now only a little over a month to go when Chief Justice T S Thakur retires, the Supreme Court collegium has taken a decision to defer recommending any new name to the Government for appointment of Judges to the apex court.

The SC collegium which had met last week has decided to defer decision to recommend names for seven vacancies that would arise with the retirement of the CJI on January 3.

Apex Body ruled to leave the finalization of names for the SC collegium under new CJI Jagdish Singh Khehar, who would take oath on January 4, 2017.

Besides Justice Khehar, the collegium from 4th January onwards Collegium would comprise four other Judges namely Justice Dipak Misra, Justice Jasti Chelameswar, Justice Ranjan Gogoi and Justice Madan B Lokur.

Justice Chelameswar has not been attending the collegium meetings since September as a protest however, some members of the collegium are planning to persuade Justice Chelameswar to attend the meetings under new dispensation.

They are of the view that Justice Chelameswar’s experience and knowledge would help Collegium testing the suitability of persons as SC Judges.

Among the present SC judges a view is fast gaining momentum that Judges be given at least five-year tenure in the apex court.

It has been observed that many Judhes are appointed to the SC only a few months before their retirement at the age is 65 years.
