CJI TS Thakur to Modi Govt- Your inaction on our recommendations is giving rise to ‘speculation and misgivings’

Why are you neither complying with our recommendations nor returning them back to us, said the CJI.

Bench headed by CJI Thakur today questioned the Centre as to why recommendations of the collegium on transfer of judges and chief justices of high courts are not being complied.

Bench asked Govt.  to file a detailed status report on such pending transfers recommendations with reasons in two weeks.

Court said that Govt’s inaction is giving rise to “speculation and misgivings.”

It said, instead of sitting over the recommendation, the Centre Govt should return them back for reconsideration.

Bench also comprising Justices A M Khanwilkar and D Y Chandrachud said that Govt is sitting over transfers for over 10 months.

AG Rohatgi replied that he needs to take instructions on the pending transfer recommendations and sought three weeks of time for the same.

Senior advocate Ram Jethmalani quiped that the top law officer of the government like AG should have all the information.

Sr. Advocate Jethmalani pointed that transfer recommendation of Justice M R Shah of the Gujarat High Court is pending compliance since February 2016.

Jethmalani said that he do not understand why is the government so interested to keep this man over there.

Yatin Oza, Senior Advocate complained that things are in really such bad shape that he cannot say things in open court with journalists and media listening.

Bench gave Attorney General two weeks time to submit report.
