Court constrained to order auction of DM’s Car as State fails to comply order for 8 years

Deceased was travelling in a vehicle belonging to the District Administration for an immunisation camp in September 2005.

A MACT, in Rajasthan’s Dholpur District had to pass order for confiscation of the District Collector’s car and auction the same to realise compensate for the family of an accident victim.

The order was passed after the State Government failed to pay up Rs 3.97 lakh compensation following the MACT (Motor Accidents Claim Tribunal) tribunal’s order to compensate the Victim’s family in 2007.

Deceased Tankamma, who is a volunteer at Dholpur’s community health centre, had died in the Road Accident when she was being driven to an immunisation camp in September 2005.

Her family had claimed compensation under the Motor Vehicle Act from the State as she was travelling in a vehicle belonging to the District Administration.

The MACT tribunal had ordered for payment of Rs 5.5 lakh compensation for deceased Tankamma’s family .

The Government withheld Rs 3.97 lakh while paying the rest of the compensation.

The car will be confiscated and auctioned if the government fails to release the rest of the compensation as per the order passed.
