FIR is under Sections 409, 420 and 120B of the IPC and Section 13 of the Prevention of Corruption Act.
The Haryana’s State Vigilance Bureau has now registered a case of cheating and corruption against former chief minister Bhupinder Singh Hooda and four officials who were in HUDA for allegedly re-alloting a plot to Associated Journals Limited (AJL) in Panchkula in 2005. As CM Hooda was also the Chairman of HUDA at that time, although the FIR does not mention his name specifically.
Apart from its Chairperson, the FIR also names HUDA’s the then chief administrator and administrator under sections 409, 420 and 120B of the IPC and section 13 of the Prevention of Corruption Act. It also includes the state financial commissioner and office-bearers of AJL Company, New Delhi.
When contacted, Ex. CM Hooda said, “I am yet to see the FIR lodged and will be able to comment only after I study it.”
AJL was then the publisher of newspaper The National Herald.
The FIR reports that on August 18, 2005, the then HUDA chief, Hooda “misused his post and also violated rules” to order the allotment of the said plot at the rates prevailing in year 1982. The plot was initally allotted to AJL in 1982 but was later reclaimed in the year 1996 after the company failed to make use of it. On September 1, 2005, the firm sought additional one year’s time to start construction, which was approved by the then HUDA officials.
The FIR further states that the then HUDA chairman ( BS Hooda), chief administrator and administrator, and the financial commissioner misused their positions to provide undue benefits to AJL causing a loss of around Rs 64 lakh to the Haryana State exchequer.
On May 4, Leader of Opposition in the Haryana Vidhan Sabha and INLD leader Abhay Singh Chautala had written to Haryana Chief Minister Manohar Lal Khattar demanding the registration of a criminal case FIR against Hooda on charges of criminal breach of trust apart from embezzlement, forgery, corruption and criminal conspiracy in this allotment.
Sector 6, wher the Plot is Located, is considered as one of the prime sectors of Panchkula and is home to a government hospital and also the offices of HUDA, Haryana State Industries and Infrastructural Development Corporation (HSIIDC), the state marketing board, and the forest department, among other such Offices.
