Judge arrested by CBI in Bribery trap Case alleges ‘Bias’ in probe by Investigating Officer

She pleaded before the Special Judge that CBI is Pre determined to Chargesheet her.

A suspended senior Civil Judge, who’s an accused along with her lawyer husband in a bribery case, has moved a special court seeking to know the status of probe against her.

The Special Judge Sanjeev Aggarwal has sought response of the Central Bureau of Investigation on the plea filed by Rachna Tiwari Lakhanpal, who’s a senior Civil Judge at the Tis Hazari Courts.

Accused has asked for a direction to change the Investigating Officer (IO) of this case alleging that the IO was “biased” & “pre-determined” to file a charge sheet against her.

The plea has said that an IO is supposed to be neutral/fair while conducting an investigation, but in this case, the IO seems to be biased, hence immediate intervention is required to change the IO in this case.

She has said since the lodging of FIR, she has been kept under dark about the progress of the probe.

According to CBI, the civil judge & her husband Alok Lakhanpal were arrested while allegedly receiving a bribe of ₹4,00,000 from advocate Vishal Mehan, who was appointed as the Local Commissioner (LC) in a case adjudicated by her for conducting an inspection of disputed property & submitting his report, at her Gulabi Bagh residence here.

They were arrested by CBI on 28th September, 2016. The civil judge was suspended after her arrest. Later they were granted bail.

CBI had claimed that during searches at judge’s residence, ₹94 lakhs in cash were seized along with 2 locker keys & other material.

She claimed she’s been falsely implicated in this case by the complainant to prevent her from proceeding in a matter which was pending before the court presided by her.
