Justice CS Karnan’s Lawyer submitted before Supreme Court that Calcutta High Court judge wanted to tender an unconditional apology but Court’s Registry wasn’t accepting his application.

Calcutta Court Judge’s lawyer also requested Apex Court to stay the arrest order against Justice Karnan.

Justice CS Karnan was was sentenced to six months in jail by Supreme Court for Contempt of Court.

To Justice Karnan’s lawyer’s request, SC stated that he could file an application and be heard when the judges are available.

Seven-Judge Bench of Supreme Court had on May 9 passed an order sentencing Justice Karnan to the jail and ordering West Bengal Police to take him into the custody. He became first sitting High Court Judge to be sentenced to jail.

Supreme Court added that a “conscious decision” was taken by Seven judges to sentence Calcutta High Court judge Justice Karnan to six months imprisonment by holding him guilty of contempt.

CJI made the remarks while he was sitting with the four other judges who were hearing issue of triple talaq.

CJI told Advocate that bench was hearing a different matter and that he should not make a mention but address his grievances before Registry.

However, Advocate added that, “I am addressing CJI only” and added that plea was related to suspension of sentence of Justice Karnan. CJI shot back “Why you are coming here everytime? Go and give it (original copy of petition) to Registry. You are not accepting any one-off procedure. You are only putting your ‘danda’ (stick) here. It does not work here”.

However, before pronouncement of Apex Court order, Justice Karnan had left Kolkata and was reported to be staying in Chennai.
