Bench said,“Whether right or wrong, do not overstretch our Orders. Bar should show some restrain.”
Today Supreme Court has refused to entertain a plea of a Practicing Lawyer associated with BJP seeking mandatory playing of National Anthem in all Courts before the start of proceedings.
The Bench of Justices Dipak Misra and Amitava Roy expressed that it is not inclined to entertain the plea of BJP spokesperson Ashwani Kumar Upadhyay.
This plea was mentioned before the Bench as on November 30, it made mandatory for cinema halls in the Country to play the national anthem before screening a movie and ensure that the audience must stand and show respect to it.
The Bench asked the views of AG’s on the plea of Mr. Upadhyay but he objected to the plea as no written Application on this was prefered.
However finally Apex Court observed that Bar should excersise restraint and not indulge in overstretching the orders of the court on National Anthem.
