DLF told to return 11 Acres of Complex Land to Park Place RWA.
In a setback to DLF, leading real estate player , the Punjab and Haryana HC has directed the developer to return back eleven acres of land to the concerned RWA. DLF’s project, `The Crest’, on 11 acres of land, which was part of a 30 acre plot which was meant to develop the DLF’s ‘Park Place’.
In response to a case by the Residents’ welfare association of DLF Park Place, the HC has also observed that the land has to be given back to this RWA.
The developer had admitted before the court that additional land contiguous to Park Place was indeed available.
Justices S J Vajifdar & T S Dhindsa of the Punjab & Haryana HC, in their 158 page judgment also mentioned that if the additional 11 acres of land or any part thereof is not available contiguous to 19 acres, then the petitioners shall be absolutely entitled to seek any other alternate relief.
The project was launched by DLF in 2006 over a 30 acre plot.
There promotional brochure submitted before Sebi mentioned that Park Place project is spread over 30 acres.
In 2013 residents of ‘Park Place’ filed a petition saying that `The Crest’ was constructed in the area meant for ‘Park Place’. In May 2013, the Punjab and Haryana High Court had ordered a stay on the marketing of `The Crest’ project.
DLF then approached the vacation bench in the Apex Court, where Justice Gyan S. Mishra removed the stay on Marketing. Since then, the case languished for over 2 years in the SC.
The SC bench presided by CJI T S Thakur in August 2015 returned the case to the High Court for its expeditious disposal.
