SC refers plea over conversion of Parsi Woman to Constitution Bench

Apex Court observed that impact of five-judge bench judgement in the triple Talaq will also be assessed.

The Apex Court has now referred to Constitution bench of five-judge the question whether a Parsi woman would automatically get converted to Hinduism just after marrying a Hindu man under the Special Marriage Act,1954.

Chief Justice Dipak Misra while heading the Bench said it will have to consider whether the five-judge bench judgement in the triple talaq matter may also have some bearing in the present facts.

Justices AM Khanwilkar and DY Chandrachud were part of the Bench and said the larger bench would examine the applicability of ‘doctrine of culture’ according to which a woman assumes the religion of her husband after marriage.

Goolrokh Gupta had challenged the Bombay High Court judgement in this regard that a Parsi Woman would be deemed to be converted to Hinduism soon after marrying a Hindu man under the Special Marriage Act, 1954.
