SC to Jayalalithaa Govt: Don’t use Defamation cases as a political Weapon against Govt. critics

While staying the Non Bailable Warrants of Arrest against DMDK chief and actor turned politician Vijaykanth and his wife Premlatha issued in a defamation case, Supreme Court of India today observed  that Defamation cases can not be allowed to be used as a political weapon against critics of Governments of the day.

Bench of Justices Dipak Misra and Rohinton Nariman said that just because some one terms a Government to be corrupt or lacking in administrative ability to govern does not mean he or she  cannot be slapped with a defamation case.

Bench opined that there shall be tolerance to criticism.

Penal provision of defamation should not be used to scuttle dissent…Courts must step in if it finds that a number of defamation cases are filed to harass citizens.

Defamation cases cannot be allowed to be used as a political counter weapon.

Bench asked for the list of Defamation cases filed in Tamil Nadu on behalf of CM Jayalalithaa against her political critics in two weeks.
