High Court had given a two-month jail term to the four
Supreme Court Bench comprising of Justice Anil R Dave and Justice L Nageshwar Rao has convicted four CPM members for “vilifying” Rajasthan HC over the alleged letting off of the suspects in a trade union leader’s murder.
Apex Court stated that no one could be allowed to hurl baseless charges against judiciary under the garb of freedom of speech and expression.
The CPM members had questioned High Court’s proceedings in 2001, alleging a bias towards the rich and influential. One of them had even claimed that money had played a role in the grant of anticipatory bail to the accused.
Apex Court did not award the jail term to the CPM members, it has asked them to pay a fine of Rs. 2,000 each. A two-month jail term which was awarded to the four by the High Court was commuted by the Supreme Court even as it expounded that they had “transgressed all limits of decency and fairness.
Supreme Court enunciated that such comments against judges and the judiciary must not be tolerated. Further stated that ,”Vilification of the judges would lead to destruction of system of administration of justice,”.
